It is no secret that many businesses have busy seasons. Accountants have tax season, car salesman have spring, and retailers have the holidays. What many do not realize, however, is that family law also tends to have a busy season. January is generally known as “divorce month” as a result of the sudden influx of divorce filings. Although a study has found that the majority of divorces take place in August, it is quite common for courts to see a spike in the number of divorces filed right after the holidays. There are several reasons that there are more divorce filings than usual in January.
One reason is that most people do not want to go through a divorce during the holiday season. Especially where the couple shares children, they frequently want to put off filing for the divorce until January to allow the children to enjoy one last holiday season before the upheaval of the divorce process.
Another reason why there are more filings in January than many other months is that although the holidays can be a magical time, it also tends to bring extra stress. Family gatherings, work parties, and making sure all the right gifts are purchased for the children can mean the parties are dealing with additional stressors that are not present during the rest of the year. If there is already friction between the spouses, the pressure and strain during the holiday season can exacerbate an already difficult situation.
Conversely, the holiday season can also be a happy time, full of celebrations and good feelings. Spouses can sometimes experience a temporary reconciliation during this time. Once the holidays are over, the spouses will often return to their previous contentious relationship, and one or both spouses will decide it is time to move on permanently.
Finally, the new year is often a time for resolutions and new beginnings. Many people use the beginning of the year as a time to take stock of their life and reevaluate their goals. If the relationship between the spouses has already deteriorated, this time of self-reflection could mean that one or both spouses decides that divorce is the best way to move forward.
