As an experienced New Jersey divorce attorney, a common question that I’ve been asked is whether or not a person who is living in New Jersey but whose spouse has left the state of New Jersey can still file for divorce in New Jersey. The answer is yes, so long as the filing spouse or the spouse who wishes to file in New Jersey is still living in New Jersey and has lived there for more than one year. If that person has lived in the state for more than one year, then New Jersey is the jurisdiction to hear the divorce.
